End User License Agreement (EULA)

1. Introduction
This End User License Agreement (“EULA” or “Agreement”) is a legal agreement between you (“User” or “you”) and Jonathan Balls (“Developer”, “we”, “our”, or “us”) for the use of the Racket Club mobile application (“App”) for booking tennis courts.

2. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by this EULA.
If you do not agree to these terms, do not download, install, or use the App.
3. License Grant
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal mobile device
- Use the App for your personal, non-commercial purposes
- Access and use the tennis court booking services provided through the App
4. License Restrictions
You may NOT:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code
- Remove or alter any proprietary notices or labels
- Use the App for any commercial purpose without our written consent
- Create derivative works based on the App
- Use the App in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to our systems or other users’ accounts
5. User Accounts
To use certain features of the App, you must create an account. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
6. Payment Terms
When booking tennis courts through the App:
- All payments must be made through the App’s secure payment system
- Prices are displayed in the local currency and include applicable taxes
- Payment is required at the time of booking
- Cancellation and refund policies are displayed during the booking process
- You are responsible for any payment processing fees charged by your financial institution
7. Prohibited Uses
You agree not to use the App for any of the following prohibited activities:
- Making fraudulent or unauthorized bookings
- Attempting to circumvent payment systems
- Harassing, threatening, or impersonating other users
- Uploading or transmitting malicious code or content
- Interfering with or disrupting the App’s functionality
- Using automated systems or bots to interact with the App
- Collecting or harvesting personal information from other users
8. Intellectual Property
The App and all related content, features, and functionality are owned by Jonathan Balls and are protected by copyright, trademark, and other intellectual property laws. This includes:
- The App’s source code, design, and user interface
- All text, graphics, logos, and images within the App
- The “Racket Club” name and associated branding
- Any updates, modifications, or enhancements to the App
9. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information when you use the App. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy.
10. App Updates
We may provide updates, patches, or new versions of the App from time to time. These updates may be automatically downloaded and installed on your device. By continuing to use the App after an update, you agree to be bound by the updated version of this EULA.
11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, secure, or continuously available.
12. Limitation of Liability
IN NO EVENT SHALL JONATHAN BALLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid us in the twelve months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Jonathan Balls from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the App, violation of this EULA, or infringement of any third-party rights.
14. Termination
This EULA is effective until terminated. We may terminate this agreement at any time if:
- You breach any terms of this EULA
- You engage in prohibited activities
- We discontinue the App or service
Upon termination, you must cease all use of the App and delete it from your devices.
15. Governing Law
This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under this EULA shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Severability
If any provision of this EULA is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.
17. Changes to This EULA
We reserve the right to modify this EULA at any time. When we make changes, we will:
- Update the “Effective Date” at the top of this EULA
- Notify you through the App or via email
- Provide you with the opportunity to review the updated EULA
Your continued use of the App after any changes indicates your acceptance of the updated EULA.
